Who actually pays for ABA in Texas

Not every plan pays for ABA. Some pay by law, some only if the plan chooses to, and some never do. Here is every lane a Texas family is likely to bring you, what it pays for, and what your practice needs to bill it.

Medicaid & CHIP

Employer & commercial

  • Fully insured employer group plans (including HMOs and small-employer plans)

    Pays (state mandate)

Required when the diagnosis was made before the child's 10th birthday. From age 10, plans may limit ABA to $36,000 a year. Normal cost-sharing applies. Chapter 1507 standard plans are excluded.

To bill it: In-network status or the plan's out-of-network benefit, the plan's prior authorization, and a provider who is Texas-licensed, holds a federally recognized credential or is TRICARE-certified (or is supervised by one).

    Sources: Tex. Ins. Code §1355.015 · TDI Order 3841 (28 TAC §21.4401)

  • Self-funded employer plans (ERISA)

    Depends on the plan

State mandates don't apply, and the Texas Department of Insurance says most Texans with a health plan have a self-funded one. The employer decides, within federal mental health parity law, which has been used to challenge ABA exclusions.

To bill it: Read the plan's own benefit document for ABA, check network status, and keep the written answer with its date.

Sources: TDI: fully insured vs self-insured · U.S. DOL mental health parity report, 2022

  • Individual and marketplace (ACA) plans

    Depends on the plan

The state mandate is written for group plans. Texas's benchmark plan lists autism services under habilitation, but it doesn't name ABA, so coverage turns on each plan's terms.

To bill it: Confirm ABA coverage, visit limits and prior authorization with the specific plan before the first session.

Public employee & military

  • Teachers: TRS-ActiveCare (and TRS-Care)

    Pays

Texas law brings the TRS plans under the autism mandate, and the TRS-ActiveCare booklet lists ABA under autism benefits. Check the current TRS-Care booklet for retirees.

To bill it: The plan's network (administered by BCBSTX for TRS-ActiveCare) and any clinical review the plan asks for.

Sources: TRS-ActiveCare benefits booklet 2025–26 · Tex. Ins. Code §1355.015

  • State employees: HealthSelect of Texas (ERS)

    Pays

HealthSelect's plan year 2027 documents list ABA regardless of treatment setting. A pre-service review is recommended rather than required.

To bill it: BCBSTX network status for HealthSelect, and the plan's recommended pre-service review.

Source: HealthSelect of Texas plan year 2027

  • Federal employees: FEHB and Postal (PSHB) plans

    Pays

Federal plans have been required to cover ABA since plan year 2017. Plans may require prior approval, case management or in-network care.

To bill it: Each carrier's prior approval and network rules.

    Source: OPM Carrier Letter 2016-03

  • TRICARE (Autism Care Demonstration)

    Pays

TRICARE beneficiaries with an autism diagnosis in an eligible plan, with no age limit. Referrals renew every 2 years and authorizations run 6 months. Texas is in the West region (TriWest).

To bill it: TriWest certification, an ACD participation agreement, network credentialing, a state license for supervisors, and ACD provider education every calendar year.

Other routes

  • Medicare

    Not a typical ABA payer

ABA is mostly a children's service, and we found no Medicare coverage statement for it. Don't plan a practice around Medicare for ABA.

To bill it: Confirm with the specific plan before seeing a Medicare member for ABA.

  • Adult Medicaid waivers (HCS, TxHmL, CLASS)

    Different service

These waivers offer behavioral support services, which are not the Medicaid ABA benefit.

To bill it: Enrollment as a waiver program provider, under that program's rules.

    Source: 26 TAC §263.5 (HCS)

  • Out of network: single case agreements

    Case by case

A payer may agree to pay an out-of-network provider for one member, often when its network can't meet that member's needs or for continuity of care. Some payers don't offer them for Medicaid.

To bill it: A written request to the payer with the member's need, and the agreed rate and terms in writing before sessions start.

Source: Example payer single case agreement policy (Carelon)

  • Private pay

    Family pays

Families can pay directly when their plan doesn't cover ABA or while coverage is being sorted.

To bill it: A written rate sheet and financial agreement signed before the first session.

Sources checked November 2, 2026. Plan terms change every year and differ by plan, so confirm coverage with the member's plan in writing before the first session. Billing4ABA is a billing service, not legal counsel.

Texas Medicaid

Texas Medicaid ABA: the basics

Texas Medicaid covers ABA for dates of service on or after February 1, 2022, under Texas Health Steps–Comprehensive Care Program (THSteps-CCP). The benefit is for members age 20 and under with an autism diagnosis from a comprehensive evaluation, made or reconfirmed within 3 years.

Who enrolls: the LBA rule

Only a Licensed Behavior Analyst enrolls. The LBA's individual NPI is both rendering and billing provider; groups do not enroll. LaBAs and behavior technicians (RBT, BCAT or ABAT certified) cannot enroll and work under LBA supervision.

The LBA's TDLR license must be current and not expire within 30 days of applying.

Codes and modifiers

Codes in the benefit: 97151 (evaluation, LBA only), 97153 and 97155 (individual), 97154 and 97158 (group), 97156 (caregiver training) and 99366 (team meeting, max 2 per rolling year).

HO is required on 97151. HO or HN is required on 97155, 97156 and 97158. HO, HN or HM may be added to 97153 and 97154. Modifier 95 is required for telehealth.

Telehealth and daily limits

Telehealth is only for 97151, 97155, 97156, 97158 and 99366, using synchronous audio-video. LaBA and technician services are in person.

Direct treatment (97153, 97154, 97155 and 97158 combined) is capped at 8 hours a day unless medical necessity supports more. One unit is 15 minutes.

Prior authorization timing

Required for all ABA services. Initial treatment up to 90 days, with one 90-day extension requested within the 30 days before the period ends. Recertification periods are 180 days, requested no earlier than 60 days before expiry.

Request within 3 business days of the start-of-care date. Since April 1, 2025, extensions no longer need the prescriber's signature. Evaluation 97151: up to 24 units.

Filing limits

Fee-for-service: 95 days from the date of service to file, and appeals within 120 days. Managed care plans set their own limits, so check each plan's manual.

Keep it on one page

Read why the LBA enrolls, not the clinic, pin the Texas Medicaid ABA desk card above the desk, and track renewal windows in the authorization tracker.

Medicaid managed care

Medicaid managed care plans in your area

TMHP enrollment is the first step, not the last. The provider then contracts and credentials with each Medicaid managed care plan in its service area, and each plan runs its own prior authorization. Check each plan's current instructions before you submit.

TRICARE

TRICARE in Texas

Texas moved to the TRICARE West region on January 1, 2025. TriWest is the West region contractor, and its provider pages cover the Autism Care Demonstration (ACD).

ACD providers complete Autism Care Demonstration provider education each calendar year, by December 31. Put the deadline on the clinic calendar for every provider who needs it.

Commercial plans

Commercial plans and the Texas autism mandate

Texas Insurance Code §1355.015 applies to fully insured group health plans, including HMO and small-employer plans, and by statute to the TRS teacher plans. It applies when the autism diagnosis was made before the child's 10th birthday, and for enrollees age 10 and older those plans may limit ABA to $36,000 a year. It does not apply to Chapter 1507 standard plans.

Self-funded employer plans are not bound by state mandates, and the Texas Department of Insurance notes that most Texans with a health plan have a self-funded one. Individual plans follow their own plan terms. At intake, ask whether the plan is group or individual, fully insured or self-funded, and record the answer with its source and date.

Licensing

Licensing: TDLR, LBA and LaBA

The Texas Department of Licensing and Regulation (TDLR) licenses behavior analysts (LBA) and assistant behavior analysts (LaBA) under Texas Occupations Code chapter 506. Licensing began in 2018.

For Medicaid, the LBA license is the starting point: it has to be current, and it should not expire within 30 days of applying to TMHP.

For your clinic

What this means for a 1–5 BCBA clinic

  1. List each BCBA's TDLR license number and expiration date. Renew first if a license expires within 30 days.

  2. Enroll each LBA with TMHP through PEMS, using the LBA's individual NPI. Plan for the site visit.

  3. Use the picker above to list the managed care plans in your area, then contract and credential with each one.

  4. Set up claims so technician and LaBA services bill under the supervising LBA, with the right modifiers.

  5. Track every authorization's start date, units and renewal window, and request within 3 business days of start of care.
